Sierra Madre: It's Still Crimesville, Right?

There was an interview with our new Chief of Police Larry Giannone the other day on The Patch (click here). Much of what Chief Giannone had to say there appeared to be in response to some of the criticism we posted in an article about the Matheson and EVG cases (click here). Naturally we were pleased to see our concerns addressed. Here is what the Chief had to say about the EVG case in his interview:

On the EVG Credit Card Scam: "This time last year, we were working on the EVG fraud scam. There's still talk in the community that nothing was done. We are still actively working with the FBI and Secret Service on this case. They are making headway on the case. It just hasn't been put in a box and put away. We are still investigating that and hoping to have some word out to the public in the near future with the results of that case."

While we are all very anxious to hear what those results might be, I am not certain that when people read the Chief's assurances they actually believed anything would happen quite this soon. Nor did many believe that if they were to read about a case of credit card identity theft at a gas station in Sierra Madre now, it would be quite like what is found in today's Pasadena Star News (click here):

Sierra Madre police seek victims of gas station scam - Investigators are looking for more victims of a scam after a customer of a local gas station reported that his credit card information was later used to buy items at other places.

Police took an identity theft report on Jan. 5 and suspect it could be tied to a Dec. 27 vandalism case at the Valero Gas station located case at the Valero Gas station located at 4 N. Baldwin Ave.

Officers found one of the gas pump doors pried open and evidence that a skimming device was placed inside the pumps and then removed, according to Chief Larry Giannone.

It's deja vu all over again.

Now I know that skepticism is regarded with suspicion by members of the Civility Block Watch Program here in town, but we're going to stick our necks out here and express some anyway. If the FBI, Secret Service and, of course, the Sierra Madre Police Department are working hard to investigate and bring to a conclusion last year's credit card skimming case at the gas station formerly known as EVG, why are these kinds of criminals still operating here? After all, we only have two gas stations to protect. You'd think that with a couple of the most highly regarded law enforcement branches of the Federal Government on the case, in addition to our own SMPD, this kind of thing wouldn't be happening here anymore.

You would have to hope that with so massive an investigative law enforcement presence due to the previous gas station credit card skimming case, all such criminals would have been scared far away. But apparently that is not the case.

Hopefully we will have some of that promised information from the Sierra Madre Police Department and our new Chief soon.

The City Council's "Mandatory Water Conservation Ordinance Update." Is it really a Disguised Water Rate Hike?

Unfortunately the City of Sierra Madre has not been very forthcoming or honest with its information on water rate related cost increases for a while now. Last year we were told that our water rates would have to go up due to needed water infrastructure repairs, only to find out later it was actually about raising money to satisfy some old bond debt obligations. And now we are hearing from Mayor Buchanan that water related Utility User Tax (UUT) rates have to go up in order to specifically fund public safety services such as the Paramedics. Which obviously sidesteps an inconvenient reality since our UUT is actually a general fund tax and can be used for anything the Mayor wants.

At this evening's City Council meeting the matter of levying heavy fines for excessive water use is to be discussed. This has been greeted with suspicion in certain parts of the community, with some suggesting that the real impetus behind these rather draconian fines is to get even more money out of the residents for water.

The City's rationale for establishing these robust fines is water conservation. Should the current drought lead to water shortages later this summer, City Hall apparently believes that they'll need an ugly stick in the form of heavy financial penalties to enforce any demands for water conservation.

However, does this ring true? Are these folks really all that concerned about water conservation? I personally have my doubts. If this City was truly all about conserving our limited water supplies, they wouldn't be allowing for any more development, right? Instead they are pushing for high density low-mod housing, a homeless shelter on E. Montecito for who knows how many transients, the Kensington and its potentially large population of old and infirm, and about as many McMansions at Stonegate as they developer is capable of selling.

Does this sound like the kinds of things people authentically worried about conserving our limited water supplies should be doing?

My suspicion is this is potentially a disguised water rate hike dressed up in a pretty party dress called conservation. Done in hopes of avoiding another Prop 218 debacle. Depending on who is calling the shots, fines for excessive water rate use could affect a very few people. Or they could end up in the water bills of a lot of people, including you, dear reader. It is that arbitrary. And if you consider all of the dishonest things claimed by the City during last year's water rate increase "process," how much would you want to trust these same individuals this time around?

The State of California doesn't want our City Hall after all

The latest word from Sacramento is that "successor agencies" to the soon to be disbanded 400 CRAs in the state will be allowed to maintain control of such buildings as their City Halls. So it looks like our little municipal palace won't be sold after all. Though things like any relevant bond debt will still need to be paid. I guess we should all be relieved about that.

And besides, what would Sacramento have done with a bunch of old City Hall buildings anyway? In today's troubled real estate market they would have certainly been a hard sell. Better to just leave them in the hands of the cities and collect their money that way.

50,000 Hits

Reader traffic on The Tattler continues to grow. We briefly went over the 50,000 hits mark yesterday, a record for any 30 day period in this blog's history. Certainly some of that can be credited to the Matheson case. Our no limits coverage on that issue brought us a lot of attention over the last few weeks. But it also brought with it some controversy, which is also good for web traffic.

I'd like to take this opportunity to thank the people lurking behind the gauzy lavender mosquito veil of the now vanished Lady Elizabeth Wistar for all their hard work. A lot of people heard about The Tattler for the first time through the efforts of these folks and, expecting the worst, came here and checked us out. And when they did they apparently liked what they saw because they have continued coming back for more.

I guess you could call that an unintended consequence. And a very happy one for us.

    It's an unfiltered look at the city politic, and not what the "establishment" and fully bought news sources are spinning at the time.
    It must be very annoying to the so-called power brokers in town, who cannot "spin" fast enough.

  3. Yesterday I was on weather.com checking the temps in cities around the country where family reside and brought up Sierra Madre, CA just to see what the day held when lo and behold! Elizabeth Wistar had blogged commens on the Sierra Madre, CA weather.com site. Gets around, that one she does.

  4. I remember Don Watts predicting water will become the big issue in town.
    As he explained, you cannot "manufacture" water, and this part of the valley's population has grown due to higher density project growth.
    Unlike the pro development people, he said this will end up biting us in the back big time, since the water table is being drawn down faster because of increasing demand.
    He said if growth continues, water rationing would have to be imposed unless development is tied to water availability.
    "Land becomes worthless when you do not have the water resources to support it".
    He said in the future, we may have to ration new water meters such as Santa Barbara had to do, and new water meter permits would be harder to get.
    The city system is now tied to neighboring towns who still believe in the concept of limitless development, and they too are sucking the water table dry, and you simply can't drill wells deep enough or fast enough.
    The lower the water table, the more energy it takes to pump what's left.
    He suggested installing solar cells in the city yard to bring down pumping costs, and at the time people looked at him as if he was nuts.
    THe City has a vested financial interest in increasing water costs, along with Cal Edison.
    We need new leadership in city hall, and it cannot come soon enough.

  6. The saddest consequence of the last election, which put Josh Moran, Joe Mosca and Nancy Walsh on the council was losing Don Watts.
    He tried to save Sierra Madre, he was a huge part of getting us Measure V, which saved our property values. You didn't even re-elect Don Sierra Madre voters!
    You now pay the price.

  8. I remember the UUT was sold as a pure public safety issue where the promise was for the funds to be used for that purpose ONLY, as well as to fund the new paramedic service.
    If that is to change, I could not in good conscience vote for the UUT increase in April,
    Period.
    If it fails in April a new proposal should be brought forward reflecting the old UUT under the new council.

    If Valero cannot protect or detect its pumps from tampering, it needs to install surveillance cameras, change its pumps to tamper proof ones, or get the heck out of town.

    Cheif Giannone does not inspire confidence to me, being hired from the outside and promoted to Cheif is not saying much for your long time officers. But if your officers like him and he inspires confidence in them that is all that matters.

    The UUt tax and the fines are done deals from the state level. The city already has the money spent.

  21. If you get on line and check other cities policy for water conservation you will see that they are quite similiar to the proposed one for Sierra Madre, particularly San Diego County.

  22. Here are the warnings and fines that Pasadena imposes which are much more reasonable. Staff needs a reality check.

    PWP will work closely with customers to provide helpful information and issue written warnings for first offenses. However, homeowners and small-business customers with meter sizes smaller than 1 �� who continue to violate the ordinance will face fines of $100 - $500 for future violations. Fine amounts are double for customers with meters of 1 �� or larger. Flow restrictors may also be used to achieve compliance. A customer does have the right to a hearing if a written request is received by PWP within ten (10) days of the date of notification.

    This crap started in 2006 when the Democratic Party called us and told us to vote for Joe Mosca.

  28. We NEVER had debit cards like this when the 76 station was there and to pay with a credit card you had to go inside and hand your card to Bill or one of his employees.

    I've purchased fuel and had work done on my vehicles for many, manty years by the mechanics at Valero in both of their locations with no problems.

    Even on the Tattler racism and hate are apparent.

I'm a glass is half full type, so I prefer to think of MacGillivray as an outstanding example of a intelligent, honest representative of Sierra Madre who is in the Republican Party, and Zimmerman as an outstanding example of an intelligent, honest representative of Sierra Madre who is in the Democratic Party. The party affiliation ain't where it's at.

    All day I face the baren waste with out the taste of water, cool water. Old Dan and I with throats burned dry and souls that cry for water, cool, clear, water.

    We have water. We have residents that will move heaven and earth not to mention water to save and conserve. Fines are the last resort of a system that is bankrupt of respect and trust.

    We don't need fines we need a new City Council and oh yes City Administration.

  37. 11:48 I agree completely. I am an independent and search out qualities of character, honesty, humility, and complete support for those less fortunate to place my vote. The way delagates, then candidates, are selected, (who really make the decisions) is a far far cry from Democracy.

    I think I can add an extra dimension to the Matheson case. Although now resident in the US (not Sierra Madre, or even CA), I am a former resident of Nova Scotia, Canada, and still regularly read the online edition of Halifax's Chronicle Herald newspaper. In fact, I am the individual, who on 13 December, wrote an email to Chief Diaz with a link to the Canadian newspaper article. I was previously aware of the case (more on that later!), but was shocked by the light sentence Matheson received from the Canadian authorities. I therefore felt a responsibility to alert the citizens of Sierra Madre of the impending return to their community of this predator.

    To her credit, Ms. Diaz responded to me the same morning acknowledging the receipt of the information, and that it had been passed on to officers Gianconne and Kirkpatrick.

    I believe it was that same morning (or it may have been a few days later, I can't clearly recall) that I also filled out, at length, a formal tip about Matheson on the www.wetip.com website which is linked to from the Sierra Madre website. I suspect it may have been this which finally forced the Fed's hands.

    But that is not all I did that morning. On 13 December the Sierra Madre News Net first broke the story of Matheson's conviction. Again, it was I who alerted the News Net to the Matheson conviction. Actually, I did so by placing a rather sarcastic comment (and a link to the Canadian article) in an another Net News article about the Chamber of Commerce Man-of-the-Year contest, or some such. The comment was deleted at the moderation step, but the article did appear shortly afterwards. And I was astonished that it appeared! Because here's the punch line of my story.... it's not the first time that I had corresponded with the SMNN about Matheson. In fact, I had first notified the SMNN about Matheson back in October, when the first article about Matheson (detailing his arrest and release on bond) appeared in the NS newspaper! Not being familiar with Sierra Madre, I had simply googled the term "Sierra Madre newspaper", and SMNN is what comes up. I thought it looked very small town, but I guess I didn't realize that it wasn't really a legitimate news organization.

    What, you are asking, was the outcome of my post on the "About/Contact" page where I detailed all the information about Matheson's arrest, and provided a link to a clearly legitimate newspaper article? As alluded to earlier, it turns out that posts there require moderator approval. And the moderator simply deleted *all* of the information without comment or reply. Based on a subsequent closer look at the site, it seems to be a one-man show run by one Bill Coburn.

    My presumption is that Bill Coburn, simply opted to bury the story and hope it would go away. During my first encounter with Net News, I also hadn't recognized their close association with the Chamber of Commerce. This should have been a red flag for me, since the first Nova Scotia article mentioned, for whatever reason, that Matheson was a member of the Chamber.

    At the end of the day, I guess Coburn figured he couldn't ignore the ultimate fact of Matheson's conviction, so did post something on 13 December. Nice job Net News!

    I regret now that I didn't take my concerns directly to the Sierra Madre police, as the result of my delay was a substantial period of time during which evidence might have been destroyed. So I feel bad - I know I'm not a journalist or a police officer and its not really my responsibility to do those jobs. Moreover, Matheson had not yet been convicted at the time of my first contact. Still, I guess I accept some culpability if evidence was destroyed -- once I realized that the News Net was simply going to bury the story, I should have tried harder, and sooner, to alert Sierra Madre authorities. In my defence, I can only say that I had incorrectly assumed that the Nova Scotia justice system was going to put him away for a very long time.

There is a difference between accusing someone of being involved in Matheson's crimes and laughing at the poor fool who tried to convince a newspaper reporter that he'd never met him when that reporter had photos of the two together on his computer screen.

    Anyone with courage and honesty to speak up and try to do the right thing to save their town has a target on their back.

    We live in a gangster run town. If you question the corruption, you are discredited, destroyed, or run out of town.

    7:14 - I am unsure if you are in some way obliquely referring to the content of my earlier post, as I am unfamiliar with the cast of characters in your charming town. However, I must emphatically clarify that I was *not* ascribing to Bill Coburn or the Sierra Madre Net News any criminal intent, nor was I implying any complicity on their part in Mr. Matheson's crimes or any subsequent effort that may or may not have been made by associates of Matheson to destroy evidence.

    I was merely pointing out what seemed to me an inexplicable absence of journalistic curiosity on the part of the SMNN, and expressing surprise at their evident lack of interest in reporting to Sierra Madre residents (what were then just) serious criminal allegations that had been levied against a member of their community. By any standard, the story that I brought to the SMNN's attention in October was highly newsworthy, and would have been treated as such by any news organization with legitimate journalistic standards.

    You may infer what you like from their choice to remain silent, but I am not suggesting that the SMNN did anything more than decline to report a story -- one which was technically already public albeit not local knowledge.

    Moderator - I believe I have already stated everything that I can usefully contribute to the matter. I think I've fulfilled my obligation to my conscience, and I really have no interest in further embroiling myself in your local affairs. Let's just agree that Bob Matheson is convicted predator and should rot in jail, and that the SMNN is a journalistic sham, and leave it at that.
