The Importance Of Community Activism

"Downtown development decisions that could deviate from our long-standing goals should be made by the entire city after a public debate and an election, and not by a few city hall insiders." - Measure V

I do like to live for the moment. And since I write posts here nearly every day you can see why. It's always day to day here at The Tattler. And yesterday we had a little celebration over the very real possibility that the first ever Measure V vote to approve a development project will be held this November. It was a big moment in the seemingly endless fight to preserve our little town.

The residents will be asked to use their vote and decide if the Assisted Living Facility (also known as The Kensington) is worthy enough of gracing downtown Sierra Madre. Since this will be the same day as the Presidential election there should be a fairly impressive turnout of voters here. I suspect that those casting ballots will vote to approve, and the ALF will be built. The other option, leaving the decrepit Skilled Nursing Facility in place as is, being too much for most Sierra Madreans to bear.

But what will actually be put up for voter sanction is still very much up in the air. This project has only just begun its approval process, and there is much work to be done. Planning Commission meetings, General Plan Update meetings, City Council meetings, these are the places where the ALF will first take shape. And what you will see put up for voter approval this November will have been crafted during these meetings. Without your input and advocacy what will be approved and built might not be to your liking. And if you were not involved, then there will be nobody to blame but yourself.

Yesterday Kurt Zimmerman and I had a conversation on yesterday's topic. He made what I thought were some good points, very close in spirit to what some people had posted in the comments to this blog. I asked him if he would write a little about Measure V and the November 2012 vote, something that I could share here on The Tattler. Here is what he sent in:

This is an enormously positive development. Councilmember MaryAnn MacGillivray, blogger extraordinaire John Crawford and the residents who spoke out in favor of Measure V deserve a great round of applause for making the developer see reason.

That having been said, I won't be celebrating until a majority of the City Council acknowledges that Measure V actually applies to the proposed Assisted Living Facility project. I am concerned that the Council will either reject the developer's request to put the project on the November, 2012 ballot, or authorize an "advisory vote," taking the position that Measure V doesn't apply.

Recall that former Councilmember Joe Mosca proposed just such an "advisory vote" on the proposed Downtown Specific Plan with the full support of then Councilmember John Buchanan.

Because an advisory vote is non-binding the Council is free to "greenlight" the project even if a majority of the voters say NO. Of course, that would violate both the letter and spirit of Measure V. The fight for Measure V is far from over, and the supporters of 2-30-13 must remain ever vigilant.

We all know that Measure V has powerful and well-financed enemies. Enough power to control the votes of 75% of our current City Council, anyway. And as we might soon see, there could be some new ploys designed to steal that vote from the residents of Sierra Madre. The issue here for them isn't so much the ALF, it is stopping Measure V from ever being used as part of any development approval process. The last thing these folks want to see is you participating in something that they believe belongs exclusively to them.

Your kind participation is needed now more than ever. Things are only just getting started.

More on the SGVCOG

Yesterday our friends over at the Walnut Tattler dropped some pointed comments about the woeful state of affairs at the SGVCOG on Tuesday's Tattler post dealing with just that topic. You may recall that Tricky Nick Conway and his little operation got hit by Caltrans with a semi's worth of accusations regarding a serious conflict of interest situation there.

So angry was this state public transportation agency that they were demanding their $240,000 back, accusing Conway of funneling much of that money through a third party company - Arroyo Seco - for his own personal profit. Arroyo Seco, which supposedly had handled a lot of the administrative work involved in what was purportedly Gold Line work, being the personal property of, you got it, Nick Conway.

This being the SGVCOG and all, Nick and his bobbleheads are now on board with a novel solution to their problem. What if instead of being a contracted employee brought on board to act as the Executive Director of The COG, Nick Conway was instead hired as an official state employee? And what if the folks who work at Nick's honey pot, Arroyo Seco, were also hired by the state and brought as employees? Then there wouldn't be a conflict of interest any more, right?

As outrageous as this sounds, that is where the SGVCOG sees itself going. And what could make this even more absurd then it already is? According to our posting friends, Nick could then qualify for a PERS Pension for all of his years of service at The COG. And after retirement he would be living on the taxpayers dime, happily ever after. All brought on because CALTRANS busted him on a conflict of interest rap.

The company that cooked up this strategy, Citygate, brought in by the SGVCOG in order to conduct an audit of their own regarding Caltrans' conflict of interest charges, wrote it up this way. This from the SGV Tribune (click here):

"In order to eliminate Caltrans' objection to contracting for staff from the private sector through a (contract with Arroyo), Citygate believes that the most straightforward solution is to directly employ that same staff as SGVCOG employees," according to the management audit.

Citygate is apparently pushing the meme that the real issue here is the practice of hiring outside help, and not the Caltrans assertion that the person who hired Arroyo Seco to work on a state transportation project funded with public money is also its owner. A wee small matter in Citygate's collective mind, I suppose.

What the Walnut Tattler folks are proposing for us is something similar to what Tom King is pushing in Walnut. King, a two term former Mayor of the City of Walnut and one time President of the SGVCOG, is pushing hard there to make certain that his City in no way contributes funds to Conway's proposed PERS Pension.

Here is their proposed Resolution for the City of Sierra Madre:

The City of Sierra Madre is committed to a high quality of life and the financial security of the community. Therefire it is resolved:

1. Sierra Madre will not accept the responsibility of a PERS Pension for the Executive Director of the San Gabriel Valley Council of Governments, a Joint Powers Authority.

2. Sierra Madre will not participate in any grants, programs or other activities with the San Gabriel Valley Council of Governments, a Joint Powers Authority.

3. Sierra Madre hereby suspends membership and payment of dues, or other liabilities to the San Gabriel Valley Council of Governments, a Joint Powers Authority.

4. The City of Sierra Madre resolves it will not financially support or participate in any joint powers authority which has been determined to be a high risk agency by any government reviewing authority.

What we need to do is put this before our City Council and see how it responds. In the past MaryAnn MacGillivray had questioned our continued financial support for The COG given all the strange shenanigans there. And as the SGV Tribune article we linked to above suggests, there will be a State investigation coming down soon for the SGVCOG and its wily Executive Director. One can only imagine what will come of that. It would be a shame if we'd have to give back any State money funneled to us through The COG. That would certainly be an unfortunate result, I'd think.

I guess we'll get to see where Mayor Buchanan and Mayor Pro Tem Moran stand on important ethics issues such as this one.

There is one other point of interest posted yesterday by people associated with the Walnut Tattler. According to them, 5 elected officials who had served with The COG were busted for various legal improprieties recently. They are:

1. Shannon Martinez SGVCOG Vice President Monterey Park
2. Former Mayor Kathe Wilson of Temple City
3. Former City Councilwoman Judy Wong of Temple City
4. Former Mayor John Tran of Rosemead
5. Former Mayor Louis Lejan of La Puente

Quite a little organization that COG. It really does attract an interesting class of people.

  3. It is a "seemingly endless fight to preserve our little town." The pressures will not be letting up anytime soon either. It's the most expensive thing about Sierra Madre. If you want to preserve it, you have to give time, energy, and money too.

      Thank you Kurt Zimmerman for your comments and your service to this community.
      When I moved here in the early 90's I had no idea of all the shenanigans going on.
      I have been active in fighting this corruption ever since.

      I now support a candidate, who DOES NOT have the out of town money, be it from unions, major political parties, Bart Doyle's Building Industry Association or the California Realtors Association. We would neither solicit or accept such money. We saw enough of that with the NO on V crowd.
      My candidate supports protecting Measure V. - Our property values! Protecting safety and our security here in Sierra Madre and has more experience than any other candidate running.

      Don't be misled by all the fancy expensive cards (where's all this money coming from?) certain candidates are already sending, or the massive signs all over our
      town, many on rental or empty properties owned by realtors or downbtown invester's club members who want to destroy our downtown.

  5. Nick has turned what should have been a cooperative organization of local cities into a vehicle for his own personal interests. And how he does this is with state and federal grant money. As long as he comes up with the cash, that roomful of worshipful bobbleheads called the SGVCOG will kiss his fanny from here to Sunday. What a disgrace.

      Well, the truth is very clear and documented, 10:04. Actually right here in the Tattler. See past columns.
      Since Measure V was passed, most of the cities in California have had devastating crash in property values, both commercial and residential. It's going to get worse.
      Sierra Madre by contrast has maintained our property values.
      One of only a handful of cities who have done so.
      The cities who have protected their property values? All have one thing in common, they control development....the residents do not allow for corrupt city councils and/or boards of supervisors to sell them out to special interests. Sierra Madre would have been sold out via the DSP. Had it not been for SMRRD, Kurt Zimmerman,Kevin and Katina Dunn and our attorney Chris Sutton.
      They saved the town. Make no mistake about that.
      Measure V is the PEOPLE'S EMPOWERMENT ACT. It must be protected at all costs.
      There is big money in this, look at the big money already surfacing to control our local city council elections!
      These greed motivated investors in the DSP projects will stop at nothing to get their gambling loses back.
      We have the power to stop them, we the people.
      Make sure you vet these candidates carefully.
      I already have. I will be voting of course for our champion, MaryAnn MacGillivray ( who supported YES ON V) and continues to support not only Measure V, but all of Sierra Madre.
      1. Security and Safety are # 1
      2. Protecting property values of residents, not a handful of investors in the destruction of our town and hillsides.
      3. Making the decisions we need to maintain fiscal responsibility of our budgets, stop giving our money to consultants and bogus state organizations like SCAG and COG.

      So far, I have only identified 2 other candidates also be committed to these issues.
      A. Chris Koerber- financial expert.
      B. John Capoccia- business manager.

      I don't know anything about Mr. Goss.
      What I do know about Mr. Braudrick and Mr. Harabedian is they are YOUNG men, no relevant experience in the major issues that face Sierra Madre. That's the good part. The disturbing part is that they seem to have unlimited funds already coming their way.
      From who? Why? Last time I saw this intensity was the NO on Measure V campaign.
      "Manchurian Candidate" Joe Mosca comes to mind.

      Please voters in Sierra Madre, educate yourselves. Do not listen to the lies you'll be told by well funded special interest groups.

    3. Good post. I agree with most everything you write. However, we certainly have seen our property go down in value by 20% to 25% over the last few years...

    4. Sorry to hear that,12:46, however, when you are located near foreclosures, you are bound to take a hit. Hang in there, I hope you're not under water. My property took a hit like that in 1993 1994, but went back up, it's come down slightly, but still way more than I paid for it in 1991. Again, it's going to take longer this time, but hang in there. Good luck, friend.
      20% to 25% isn't near as bad as some areas.
      I know people in Simi Valley and Tarzana, nice areas, but over built.
      Property has gone down 50% since 2008.

    5. Oh, I know... I've been in town since 1975, so have also seen the housing market go up and down. We are far from underwater... fortunate, compared to others that are really suffering far worse. Looks like the economy is in recovery, and we are hopeful that things will turn. Thanks my friend. We voted for measure V, and want our CC to work for us! Enough, with the schemers and scammers!

  9. Nick Conway is the biggest CON man ever. And if you look at his latest "three year goal" the repeat of "Who" are in charge tells you exactly what bobbleheads are in charge of leading the lies and corruption as orchestrated by Conway. What should be most interesting in the goals is Conway's goal of providing the group HIS version of "summary of talking points after each Board meeing" - translation - "here's what I want you to say - regardless of what really happened" Loyal Bobbleheads forward march, while Conway laughs all the way to the bank.

  10. Ask each and every candidate for Sierra Madre City Council--how did you vote on Measure V. No excuse to not answer will be accepted. You want us to vote for you, we want to know how you voted then.

    Then ask--how will you/would you vote to place the ALF on the ballot in November for a citizens vote to uphold the principals of Measure V? It may already be on the ballot but the question can be reframed and asked again anyway.

  12. During a meeting of the City Managers the other day, Conway was overheard muttering the Arroyo and the COG will soon be going after those who are going after him. In another meeting a couple of weeks ago Barbara Messina repeatedly referred to an open government advocate who wanted to look into the operation of the COG as an idiot.

    At a retreat a week or so ago, Nick Conway has been commissioned by the COG to write standards of conduct procedures to go after members of the COG governing board who do not exhibit proper conduct. Obviously he is going after Tom King. The person who was picked to assist write this him was Barbara Messina.

    Messina and her husband, another former Councilman from Alhambra own vast real estate holdings in Alhambra. I wonder how much of that is tied into redevelopment money and the City of Alhambra.

    Messina was recently fined 15 grand by the California Fair Political Practices Commission by having an illegal secret campaign account managed by her husband to smear her opponent.

    Remember the Plumbers Committee from Watergate? This is the epitomy of an intolerable situation. Government going after the good guys? This is reminiscent of Nazi Germany, Chicago politics and arrogance all rolled into one. Where is the public outrage and why aren't the politicians standing up?

    Only answer that comes to mind is that we have major corruption problem or the people we elect to office are absolute MORONS.

  14. On February 16th 2012 at 6 PM those COGSTERS not currently under indictment or in prison will be meeting to implement the plan to hire Nick Conway and give him a PERS pension. We need to get people there to pull the plug on all of this COG stuff.

Does anyone see irony in the fact that COGSTER Barbara Messina is writing standards of conduct immediately after referring to a member of the public as an idiot for asking to know what is going on? And she was nailed for improper conduct by the State herself? I am REALLY worried about what is going on in the San Gabriel Valley COG. I want to see this in action. I will be there on February 16tth and I want mug shots of these people in case they want to pick my pockets on the street.

    He's been on the council to benefit his employer, push his own ego agenda and has actually accomplished little or nothing.

  21. If the state wants the money back that Conway illegally funneled through his own business, they should be getting it from him directly. Maybe if he had to pay back that $240,000 out of his own pocket, since into his own pocket it went, he might actually consider his actions before defrauding the government or taxpayers again. "Conflict of interest" is quite the understatement for what this guy did. He awarded himself a government contract - pure and simple fraud.

    The City of Sierra Madre should absolutely dissociate from this very corrupt COG organization and the state attorney general's office should launch a comprehensive investigation into its nefarious dealings over the past decade. Conway's recent "indiscretion" is only the tip of a massive iceberg, I'm sure.

    Back to the first item of business, what Zimmerman cautions is likely true - we're not out of the woods yet. These folks will do anything in their power to block a Measure V vote, despite the project principal's insistence that the project go to a vote as mandated by local law. Buchanan and company have proven repeatedly that they are not above breaking, bending, convoluting the law to their own purposes, regardless of the negative impact such actions will have on the community. "Fasten your seatbelts - it's going to be a bumpy ride!"

  24. Thank you for letting me know that Nick Conway is going to go after me. I really am not too worried. My City Attorney agrees with me that the SGVCOG relationship with Nick Conway is a conflict of interest related to grants. If he sues me, Conway will be paying me damages until he no longer has gastronomic retention. Believe it or not, he threatened to sue me twice while I was President simply for asking about CALTRANS. I have heard he visited the Tribune and threatened to sue them for running stories about him.

    On a brighter note, I received a call tonight that the SGVCOG received direction in a corrective plan on how to get off of high risk. That is really a good thing.

    The really bad thing is that I am on the executive committee of the SGVCOG and no one has shared that plan with me. It arrived in December. Mr. Conway likes to not communicate bad news to the people who allegedly oversee him. During my last six months on the SGVCOG Presidency, because of my attempt to find out if we were at risk, and what we had to do to get off, I was told it was "all taken care of." When CALTRANS came to brief me, the told me NOTHING had been taken care of.

    The facts here are very simple. The SGVCOG is at high risk only because of the actions or failure to act by Mr. Conway. The SGVCOG is throwing tens and tens of thousands of dollars in consultant fees, lawyer fees, auditor fees and God knows what else into a furnace because a contract employee is in total violation of his contract with the SGVCOG and is at high risk. That cost should have been the responsibility of Conway, not the taxpayers.

    I received a phone call once from Gil Aguirre wanting to know my address to serve me a lawsuit for not complying with a public records request. Aguire found out that Conway never bothered to give me the request even though it was addressed to me. That is either complete incompetency or arrogance.

    My esteemed colleagues are very angry with me right now. They may try to censure me, I really do not give a rat dropping. You are either in a conflict of interest or not. After six or seven years of being in a conflict of interest, you would think that it would be time to enforce the severance clause of the contract.

    Leadership means making a difference. We need the leadership of an informed and inquisitive public to help fix this. Having been involved in local politics for a few years, the biggest corrosion of City governance is when the people are fed manure like mushrooms. Well the lights have been turned on. The people need to come forward and act. We work for you and you are our bosses.
