Mountain Views News Publisher Susan Henderson's Very Confused Defense of the UUT

It doesn't really matter whether you are voting for a renewal of the Utility User Tax (UUT) this April or not. Either way you'd have to be put off by the odd misinformation being put out by the Mountain Views News this weekend. Ostensibly an even-handed approach designed to give you the voter the information needed to make the right decision, it is rather a hodgepodge of cobbled together and contradictory nonsense that on the whole makes very little sense whatsoever.

Susan's article begins with the following explanations regarding the two different UUT Measures up for a vote this April. Despite previously published claims made to the contrary, this appears designed to reassure the voters of the necessity to reconfirm the 2008 decision to raise the UUT as much as 6%. The reason being it is all somehow connected to vital emergency services such as the Paramedics, Fire Department and Sierra Madre's Police Department. There is also a short section at the end of the article that discusses the "no" vote position, but outside of dropping a few names little corroborating information is supplied.

Sierra Madre will be faced with making a decision in April regarding two Utility User Tax Measures. Measure 12-1 will, if approved, extend the current "UUT until its sunset or reauthorization and provide funding for vital city services." Measure 12-2 if passed, will allow "voters to ask that the City Council use additional tax generated by the UUT to fund General Fund's Public Safety Services budgets, including maintaining the Paramedic programs."

Both are, in essence, an extension of the measures passed in April of 2008. A that time, Measure U proposed a temporary increase in Sierra Madre's UUT up to a total of a 12% tax and extending it to cover a broader range of taxable activities.

Measure UA also passed in 2008. It was an advisory question about what to do with any additional funds raised if Measure U passed, just as measure (sic) 12-2 will do if Measure 12-1 is passed.

The User Utility Taxes, which have existed in Sierra Madre since 1993, go to the general fund. With the passage of Measure U and UA in 2008, the specific purpose was to support public safety, i.e., the city's Police, Fire and Paramedic programs.

Susan Henderson then proceeds to supply information that contradicts what she has said in the first 4 paragraphs of her article. The cite can be seen below. That she claims to have a quote from 3 members of the City Council to buttress her assertions is equally troubling as it gives the appearance that their reasons for authorizing a vote on the renewal of the 6% UUT increases have changed after the fact.

Current Sierra Madre Mayor John Buchanan and Councilpersons Nancy Walsh and Josh Moran submitted the arguments in favor of the measures. Their justification says in part, "Today, the city is faced with even greater external financial challenges; the recent windstorms have placed a $500,000 (and rising) dent in reserves, the dissolution of the Community Redevelopment Agency leaves us with approximately $800,000 in potentially unfunded expenditures and the rising energy costs are draining our already whittled down budget."

So which is it? Do Measures 12-1 and 12-2 need to be passed to maintain emergency services such as paramedics, fire and police as previously stated? Or is that money required to help make up budgetary shortfalls caused by windstorm damage and the outrageous spending spree that preceded the shuttering of the CRA?

There is also the matter of Susan's chronology for these claims. The UUT language for the April ballot was completed and approved by the City Council on December 13, 2011 (click here). The news that the State Supreme Court issued a decision that would effectively end all Community Redevelopment Agencies didn't occur until December 29, 2011 (click here).

And the news that neither the Federal or State governments would be footing the bill for windstorm damage clean up in Sierra Madre, or anywhere else for that matter, did not even begin to break until December 30, 2011 (click here). Another unanticipated debacle, with this one leaving the City of Sierra Madre holding the tree and debris removal bag.

So how could the City Council have known that these untoward events would be the reasons for voters to renew the UUT on December 13 when they hadn't even happened yet? I was not aware that the Mayor, Mayor Pro Tem and Councilmember Walsh possessed any such powers of clairvoyance.

One more question. Can it be that the quote Susan credits to these 3 City Councilpersons is from the sample ballot mailer? Will this be their language justifying a "yes" vote on both the binding and advisory UUT measures? If so, it would certainly stand as proof that their arguments have been changed after the fact. Which certainly lends an air of deceptiveness to the entire mess.

  1. I will not vote for any raise in the UUT because Buchanan and pals LIED to us about why they needed to raise our already sky high water rates.
    THEY LIED. We are voting AGAINST any tax raises put together by this current Buchanan regime.
    MacGillivray pleaded with them to make a sensible compromise, to no avail. The Buchanan, Mosca,Walsh, Moran majority wouldn't go for a plan that made sense....why? One reason, MaryAnn promoted it. The other reason is it is pro over development, pro Sacramento special interests, which they follow like sheep.


    They all dislike MacGillivray because she stands for:
    1. Experience
    2 Integrity
    3. An excellent sense of reality

    Something these other council members all lack.
    The only experience they have is following the orders of Bart Doyle (a man who has nearly destroyed integrity in this town).
    They all lack integrity.
    They all have no common sense of reality, they do not work for the common good of the residents of Sierra Madre.

    Susan Henderson is their paid "mouth piece".
    She is a convicted liar and cheat.

  2. After the deceptions pulled by Mosca on the voters, one must look at not what is said, but the people who back the candidates.
    When people run for office, they will say anything to win.
    Look at who endorses the candidates, this will go a long way in seeing where they will stand after they are in office in this town.

  5. The UUT was passed originally to fund emergency services only, even though it is in the general fund.
    If the UUT passes, it will be used to fund other costs, including the loss of the CRA funds.
    Do you really wish to provide developer welfare out of your pocket?
    The General Fund is used to fund ANYTHING the City feels it wants to. Of course, Moran,Colin, and Walsh want it.

    It gives them a blank check straight from the tax payers.

    An important part of it's passage is to take away the limits on how the money will be spent.

    Do you really want to see these people spend with no restraint?
    Historically,we have a wind storm every year at this time. A contingency fund for these things already exists, and can be easily paid for without raising the UUT from this designated reserve.

    4. 10:37, yes the screed is getting stale - but do you know, what is the fact in this matter? Is Braudrick against the UUT or for it? Same question goes for Harbidian, Koerber and Goss. Two of the candidates are on record as opposing it - how about the other 4?

  7. Neuroblast, thank you for the link to the Hildreth's ongoing saga with the corrupt city officials. Anyone who thinks that corrupt politicians are not intentionally trying to demoralize the Hildreths, hasn't been paying attention. It's the "rusty pipes" strategy applied to one individual. The pols don't want the wine bar on their vision of Montecito, so they are trying to strong-arm the Hildreth's out with lies and legal fees.

    Jeff is a dreamer in the best sense of the word, and the pols are schemers in the worst sense.

  9. It is revealing that the Mayor and his bobbleheads are claiming the UUT is the solution for their CRA spending spree. This shows that they never intended to use it for public safety. Instead it is going to help pay for the $800,000 in debt caused by their spending for such vital projects as the consumer preferences survey and the wine tasting room.

  13. Check out John Capoccia's blog on the Sierra Madre Patch. It's a very well thought out argument against the UUT. Finally a City Council candidate who is willing to take a real stand on an issue. This is what we need on the Council.

  14. With the CRA gone, the City want us to believe that the only way that our services are going to survive is with the approval of the UUT. How about the City has to function within it financial limits like every household in Sierra Madre has to do.
    How about stopping the abusive lawsuit against the Hildreths and save our town the expense of the attorneys and the probability of the loss of thousands of dollars if the Hildreths win. I for one would love to know how much the City already spent and how much more are they going to spend on the lawsuit against the Hildreths. What a waste of money. There has to be a bigger plan than just the Hildreth or way would the City be spending that much money to fight the Hildreths. It makes no sense.

  17. Sierra Madre is fortunate to have the quality candidates that have put themselves in contention for City Council. Personally I admire a man that continues to maintain a home for his son and former wife even if it means reduced circumstances for himself. I also support a serving Councilmember who has lived in Sierra Madre for 40 years and servied on the City Council for 12 of those years, demonstrating fiscal responsibility and unwavering support for its citizen. Two of the candidates have been speaking their minds at the podium, in local media, and given their statements so far, are fiscally conservative and intent on keeping the town within its budget. Two are new to the fray and need to do more to get their views to the public, but nonetheless longtime residents.

    There is no need for the lies, innuendo, and demeaning statements a few posters trot out every opportunity. The best way to support YOUR condidate is to highlight their contributions.

    Why does everyone lump Moran with Colin?

    Is that not an ignorant stereotype?


    I would like to have an interview on the TAT with Colin.


    The ASSUMPTION IS just because he lived with MORAN that they think alike.

    Is thinking alike a catchy disease? Did they live together, or did Colin rent space?

    1. Think of it this way: Would you trust someone who lived in Mattheson's house? If you like what Josh Moran stands for, then you won't see anything strange in Braudrick's association with him. No need to be scared. Maybe you liked Joe Mosca too. And yes, people that live in close proximity tend to share opinions. Life gets difficult otherwise.

  23. I'm really glad that there is such a clear cut issue for the candidates to declare themselves on - sort of like the Downtown Specific Plan days. They were asked for a "yes" or "no" on the DSP. The "yes" candidates lost. Of course it's well known that one of the "No" speakers was lying, but still, it's good to have an issue that really shows a person's basic ideology. So one by one, candidates need to say "yes" or "no" on the UUT.

Go County!!!!Obviously our morally corrupt city sitting establishment has been fleecing us through fraud and deception.This is not to say the County is not also guilty of questionable practices as well.However,we are paying for these services through our taxes and the quality of their service is far superior to what we can expect from the rank amateurs we currently employ.Nothing in this world is perfect but we don't have to be dinged to pay for 3rd rate service!

What's with the moaning and grousing about the city taking us to the cleaners.When the suggestion was offered by Kurt Zimmerman regarding a forensic audit,it was rejected out of hand.Apparently no one wanted to attack a sacred cow!Just maybe if we had one,things would not be in such a muddle as they are now!Corruption runs long and deep and it gradually becomes a part of the institution.No one ,therefore,wants to dig into it as it may uncover too many secrets.

  28. I hope the editor has seen the "no way in hell" story about the auditing of redevelopment agencies by an anonymous finance person. The story seems to only be in the SGV Trib and PSN. Mr. Sutton commented. Mr. Kennedy of the buh bye CRA commented and I don't know what no way in hell means. Does the person think we are in hell? Is he a satanic finance person, or an idiot cousin of the family that runs City of Industry? My snarkus psychicus sees a lot of red lining in the debts claimed necessary by several cities. Mr. Kennedy claims a comprehensive cleanup of the law is necessary, that is going to land him in a very hot seat.

    Dawn Wildman, national coordinator for the Tea Party Patriots, tells weekends on All Things Considered host Guy Raz that the Tea Party is still out there working.

    "We're all feverishly working and doing things, I just don't think the focus is on us," Wildman says, "it's all about this presidential election."

    Wildman says right now their focus is on smaller races and local elections: school boards, supervisors and city councilmen.

    1. You know what is kind of jarring, and as a lifelong Democrat I have struggled with this. Right now in Sierra Madre the Tea Party is a stronger advocate for resident rights than the Democrats on the City Council. The popular perception is that it is the Republicans that are always in bed with the corporations, and at the expense of individual citizens. Yet here in our town it is exactly the opposite, with the Democrats on the CC selling us out every step of the way. All for the benefit of large corporate interests like Edison and various national Realtor concerns. Do you find this to be as depressing as I do?

    2. The ironic thing is, that national politics has had a bearing on our local scene even though we think otherwise. This is new or at least new in the past 10-12 years. We have always had opposing factions and ideas on how the city should go, but they have been local factions. Now, it is vastly differnt as we struggle to keep our quaint town as it is, vs. what those in bigger governments want us to be. Yes, moderator, it is depressing.

    3. I am working for MaryAnn MacGillivray, putting yard signs up. There are 4 of us putting up signs, two Democrats, one Republican and myself, a registered Independent.
      So far, as in last 2008 election, 60% of people who want MaryAnn's signs are registered Democrats. MaryAnn always attracts supporters of integrity, who appreciate her integrity and hard work for the residents of this community. Doesn't matter what their national political leanings are either.
      I think it's just a small mean spirited group who are trying to make our city council election into a national political issue. It's total nonsense.
      Sierra Madre never used to involve political party affiliations with our local elections. Then Joe Mosca brought in the Democratic Party of Los Angeles and it started this unfortunate situation. John and I were registered Democrats at the time and changed to independents after Joe did that. We found it offensive.
      MaryAnn gets all donations, mostly very modest ones, from local residents, Democrats, Republicans, Independents.
      She doesn't solicit nor would she accept donations by political parties or out of town organizations, such as the Building Industry Association or the California Association of Realtors or any other special interest group.
      We welcome all residents to join us in electing MaryAnn, who want a fiscally responsible Sierra Madre city government, who care about our safety and security and protecting our property values, as in Measure V. It's only a very small greedy bunch of gamblers who solicited and recieved all the outside money after they invested in the DSP, thinking they could get away with it.
      MaryAnn stands for the residents, ALL RESIDENTS, no matter what their religion, political affiliation, life style preference, race, nationality. You can believe me, if MaryAnn or anyone I work with stood for anything else, I would not be working with them or voting for them.

I've quit the Democratic party to become a registered Independent because I couldn't tell the difference between the lesser of two evils political parties. Now I'm down to choosing between the candidates who I think will do the least damage in their tenure in office. I, like you, am weary of being pandered to before an election and sold out immediately after.

  31. The wine taste was lightly attended, but wonderfully laid out, with many wineries and food from some of the local restaurants. Kudos to Bill Sullivan for getting the wine reps, and to chair Sue Levoe for her hard work in organizing the event. It wasn't the event that it has been in the past as a social event for many, but a mere "wine tasting". But, it did give the candidates a chance to mingle. Hopefully the event managed to make some monies for the Friends of the Library, which was all it was about.

  33. A lot of people support political parties in the same way fans support sports franchises. Try and get them beyond "our side good, their side bad" thinking, and they are completely lost. They in no way understand the serious issues facing this town, nor do they care to find out.
