Long time Tattler readers are familiar with the name of Tom King. A former Mayor of the City of Walnut, he went on to become the President of the San Gabriel Valley Council Of Governments. The COG, as Nancy Walsh puts it, is an organization that many feel has developed some serious ethics issues over the years. Particularly the folks at CALTRANS, who apparently have had their fill of the shenanigans from SGVCOG's Executive Director, Nick Conway. And nobody is more concerned about this than Tom King.As a bit of background, there was a big expose' on the latest troubling revelations about The COG in yesterday's San Gabriel Valley Tribune (click here). The article, "Regional governing board criticized for failing to release early version of audit," includes a lot of important information to be sure. But to the point of today's post, here are the charges that were leveled at the SGVCOG's Nick Conway by CALTRANS:
Funding at risk - Caltrans has release two audits - one in 2006 and one in September - that concluded that the relationship with Conway caused a conflict of interest. The report referred to Arroyo Associates as AAI.
"By acting as the executive director and also providing services and the staff for the day-to-day operations of SGVCOG, the owner and president of AAI (Arroyo), was making management decisions for SGVCOG that resulted in financial compensation to AAI (Arroyo), and, in turn, resulted in financial compensation to the executive director as the owner and president of AAI (Arroyo)," the September CALTRANS audit read.
In other words, SGVCOG received money from CALTRANS to perform Gold Line related work, and Nick Conway, as its executive director, awarded a lot of the administrative work to a subcontractor called Arroyo Seco Associates. And who owns Arroyo? Nick Conway, of course.
It has been estimated that out of The COG's $3 million operating budget for the year, a full $1 million of that was pumped directly into Arroyo. According to the CALTRANS folks, Conway funneled public money it was his responsibility to properly oversee into a third party company that he owns, and for his own personal profit. About as big a conflict of interest as you will ever see.
And to think Sierra Madre pays dues to this unethical mess.

"Members of the Legislative, state, county, district, judicial district, and city officers or employees shall not be financially interested in any contract made by them in their official capacity, or by any body or board of which they are members. Nor shall state, county, district, judicial district, and city officers or emplyees be purchasers at any sale or vendors at any purchase made by them in their official capacity."
Nick Conway (dba Arroyo Seco Associates) provides management and administrative services to a joint powers authority (SGVCOG) and is paid a monthly, fixed price retainer for its work. As part of its duties, Nick Conway manages the activities both of subcontractors to the joint powers authority and/or other public entities who work on publicly funded grant programs that are awarded to the joint powers authority. Nick Conway gets additional reimbursement for its management activities associated with the grant programs.
Nick Conway identifies grant programs to be pursued by the joint powers authority and prepares the grant applications and is compensated by the joint powers authority for doing so; and Nick Conway develops his own scope of work and proposed compensation amounts in connection with the grant programs, negotiates those matters directly with the grant funding entities and subsequently recommends the scope of work and compensation amounts to the board of the SGVCOG as part of the board's grant approval process, and Nick Conway then manages the grant programs on behalf of the SGVCOG.
That would appear to violate both State and Federal Conflict of Interest laws, and places all San Gabriel Valley COG member agencies (cities) AT RISK for the recall of Grants Adminstered by the SGVCOG. That is an unacceptable risk to my community. Conway's conduct is unacceptable and does not meet ethical standards required by my community or City Council. If the SGVCOG governing board fails to correct this, I will recommend that we suspend our membership in this organization.
In other words, if Nick Conway is found by the Feds to have been in violation of applicable Conflict of Interest laws, the Federal money funneled to Sierra Madre through the SGVCOG would all have to be all paid back. No matter how long ago it was spent. Something that could very well not only bankrupt us, but a good portion of the 31 cities unfortunate enough to belong to the SGVCOG as well.

Coming on the heels of revelations regarding the huge sums of money the City of Sierra Madre is going to have to cough up for both windstorm clean up and the consequences of that ill-timed CRA spend-a-thon, having to pay Washington back its money because the SGVCOG and its Executive Director got busted in a Federal/State ethics probe could be quite a debacle for this town.
And if what I have been hearing today is true, Federal and State investigations might not be too far off in the future.

I remember MaryAnn brought up the corruption at the COG during a City Council meeting. Buchanan did everything he could to make sure nothing came of it.
ReplyDeleteMaryAnn, unlike most of the city council members actually attends all of these meetings. She speaks out against them, at their own meetings, if she thinks their policies are not in the best interest of Sierra Madre. She always has.

Walsh has no clue what is going on and never reports the meetings because of that. If this isn't reason enough to put MaryAnn back on the Council, I don't know what is. DeletePage views/ hits do not equal unique visitors. Nor do they equal page impressions. Nor do they really measure anything at all. Web designers gave up using counters in the 90s (15 YEARS ago!) because they were SO inaccurate and companies were sued for using them to calculate ad revenue. I tell you this, John because it really is common knowledge, I care about the Tattler, and it's embarrassing that you keep your counter and that you report how many hits you get. It's also embarrassing that your readers talk about how many hits you get around town. The way Blogger counts page views is different from the way that Google AdSense pays out on the actual impressions - there are many clicks involved with getting the comments to open up etc, page refreshes. etc. SEO scam artists trick people into looking at their "pageviews" on Blogger then sell them a product based off of the inflated stats that end up not paying out because they are inaccurate.

If you recall, at one time Don Watts, and Maryann, tried to remove the city from SGVCOG AND SCAG BY refusing to pay dues to these organizations, because of irregularities. Mosca and Buchanan voted to stay in.

DeleteRegarding protecting ourselves against corruption, don't forget to attend the General Plan Update Steering Committee meeting, 6 pm tonight, and speak up! The Committee is extremely hard-working, especially Chair Delmar, but "dwelling unit" was not minutely defined in the last General Plan, and look at the way Elaine and co. spun it to make it fit for the ALF, going against the Planning Commission in the process. Land use will be discussed tonight, and you need to let City Hall know they can't get away their shenanigans! If you're not there, City Hall thinks you're not paying attention.

The great thing about public comment is that it is at the beginning of the meeting. You can order a pizza downtown, walk to city hall and speak your mind, and by the time you are done with your spiel dinner is served.

And a report on the ridiculous expense of maintaining a city owned yacht for L.A., defended weakly by Villarigosa as a great way to see the port. Mainstream media!

I know the GPSCU meeting is really important - it's only been going for two years or so, but tonight is the premier of Doomsday Preppers, which I think is an event far more eminent than the end of the GPSCU inquest. Since Mosca left town no one's even mentioning a two year timeline.

Went to SGVCOG' site, they are going to have a city managers steering committee meeting on FEB 8, at El Monte City Hall. Mr. Bobadilla the El Monte city manager is heavy on the Alameda Corridor project. 5.3 and 5:10, on the agenda will be juicy, 5.3 addresses audits and dang don't hold me to the 5:10 but it states "discussion of the cal trans settlement". Maybe some of you ought to drive down the hill, take your cattle prods, since it is a steering committee.

(If they don't, we should have our candidates post their donors to show we are not taking money from outside groups.) If they do have to list, do they put the name and the quantity? Or is it just the name? Does anybody have access to this? Can we post it on the Tattler?

DeleteThey don't have to disclose until late March. By then many people have already voted. They need to sign a pledge not to accept union/association/political funds.
DeleteInteresting audit. Worth reading. Not an audit at all. Just a inside guy hired to do a PR piece. Audits have detailed findings and support documents. The Citygate report just acknowledges that there is a long standing conflict of interest and that Conway can be hired with a PERS pension paid for by Sierra Madre to protect him in case he has to spend time in Federal prison. Reading into who was interviewed, it was clear that they only interviewed buddies of Conway, and did no audit. Conway is the Wizard of Oz behind the screen. The COG directors are the Tin Man, the Lion and the Straw man. What we need is for the FBI to come in and search the place, and follow the money into Conway's pockets or those politicians who are curiously protective of him.

DeleteThe candidates have to file a financial statement three times during the campaign, the last one being after the election. So, many crooks will hold out their reporting until the last one so no one knows who supported them until after the deed is done. The City Clerk is responsible for collecting those reports and can give you copies of past and present reports.

Then ask the City Attorney if it approptiate for Sierra Madre to give our tax money to an agency as described above that has been found to be a high risk agency because of the conflict of interest that has been found by Caltrans.

This needs to be agendized for the next meeting - and there's plenty of time to set it up.

Andre just bagged John Tran from Rosemead who immediately copped out. Tran is probably singing like a bird too. Don't underestimate the Feds when they get their interest up. If you noticed they announced that Tran was copping out even before he was indicted.

Nick Conway has been commissioned by the COG to write standards of conduct procedures to go after members of the COG governing board who do not exhibit proper conduct. Obviously he is going after Tom King. The person who was picked to assist write this him was Barbara Messina.
ReplyDeleteMessina and her husband, another former Councilman from Alhambra own vast real estate holdings in Alhambra. I wonder how much of that is tied into redevelopment money and the City of Alhambra.
Messina was recently fined 15 grand by the California Fair Political Practices Commission by having an illegal secret campaign account managed by her husband to smear her opponent.

That brings to five the number of COG mayors who hit the bucket in the last year or so. We still need more for a quoroum. Help me... SIXTEEN PERCENT OF THE MAYORS IN THE COG GOT BUSTED AND CONVICTED FOR FELONIES IN THE LAST YEAR OR SO.
