Sierra Madre Weekly: 5th District Supervisorial Race Heats Up in the Courtroom

Mod: It is interesting to note that in the race to replace Michael Antonovich for our seat on the Los Angeles County Board of Supervisors, the Republican candidate, Kathryn Barger, apparently took the Democratic Party candidate, Darrell Park, to court for suggesting in his ballot statement that she supports Donald Trump. Something that has left Ms. Barger both deeply dismayed and dialing for her lawyers. Here is how the Sierra Madre Weekly describes all of the action (link).

Donald Trump Opposition Sparks Writ in 5th District Race

Los Angeles County Supervisor candidate Kathryn Barger filed a petition for writ of mandate against Registrar-Recorder Dean Logan and fellow supervisorial candidate Darrell Park last Monday.

The writ takes issue with statements in Park’s candidate statement that reference his opposition to Donald Trump’s candidacy for president and the support he has earned from the Los Angeles County Democratic Party.

There will be a hearing on the matter in the Los Angeles Superior Court scheduled for Thursday, Sept. 8.

Bill Carrick, with Kathryn Barger’s 5th District Campaign, took exception to our story last week regarding the writ Barger filed against opponent Darrell Park:

California law allows candidates to have a 300-word ballot statement to go in the official ballot pamphlet. Under California law, a candidate in a non-partisan race cannot refer to partisan affiliation. Darrell Park violated the law when he mentioned in his ballot statement he was endorsed by the Los Angeles County Democratic Party.

Darrell Park also violated the law that prohibits attacks on your opponent in the official ballot statement. Park attacked Kathryn Barger, saying she was a supporter of Republican Donald Trump and his agenda. This is not only a legally prohibited attack by Darrell Park. It is untrue. Kathryn Barger does not support Donald Trump or his agenda and will not vote for him. The Barger campaign is asking the court to have Darrell Park remove these illegal statements from his ballot statement.”

Beacon Media contacted Darrell Park for his thoughts on the writ:

"Unlike Kathryn Barger, I am proud of my strong opposition to Donald Trump and believe it is important to inform voters that I stand against Trump’s divisive and hateful rhetoric. My candidate statement went through a thorough review by the Registrar Recorder’s office after the closing of the filing period for both the primary and general elections. It was approved both times because it does not mention my opponent by name and abides by the rules. This action by Barger’s campaign is nothing more than a political stunt, which aims to waste taxpayer money and bleed resources from our grassroots campaign.”

Mod: So who won in court? According to the Los Angeles Times it was Kathryn Barger who prevailed.

County supervisor candidate can't link rival to Trump in voter pamphlet

Kathryn Barger, a candidate running to replace retiring Los Angeles County Supervisor Michael D. Antonovich, won a legal challenge Thursday over a rival's candidate statement that implied Barger supports Donald Trump.

Barger, who is Antonovich’s chief of staff, is in a runoff with Darrell Park, a former staffer with the White House Office of Management and Budget turned entrepreneur.

      At issue is $150,000 which was granted to Trump by the government, which Trump claims was due to his generous help following the worst terrorist attack on American soil. In April, Trump gave an interview to TIME magazine and boasted, “It was probably a reimbursement for the fact that I allowed people, for many months, to stay in the building and use the building and store things in the building.” One can note Trump, even then, hedged his lie by saying “probably a reimbursement,” of which he was just so proud. He went on to create a fake story of emotion, “I was happy to do it, and to this day I am still being thanked for the many people I helped. The value of what I did was far greater than the money talked about, much of which was sent automatically to building owners in the area.”

      If Donald Trump is being thanked for his service to New York City following the 9/11 attacks, the individuals doing the alleged thanking can not be located. In fact, there is not a single person on the record ever thanking Donald Trump for allowing them, or their organizations, to use his property at 40 Wall St.

      A simple search of records from the “Empire State Development Corporation“, which was in charge of administering the repayment for the recovery program, found that Trump was indeed reimbursed but not for the reasons which he publicly stated. In fact, Trump’s company requested reimbursement for “repair”, “cleanup”, and “rent loss.” Absolutely none of the records show Trump ever asked to be compensated for helping individuals, and there is absolutely zero evidence to substantiate Trump’s claim. What the evidence does show is Trump lied again – and this time his lies dishonor the 2,997 individuals who were killed on that horriffic day.

      Furthermore, even if Trump were telling the truth and the records magically disappeared, which they didn’t, there is still the lingering fact that the program recovery program was only for reimbursing businesses which suffered uninsured losses, and not for reimbursing individuals for their philanthropic work. David Catalfamo, who was working with New York’s governor at the time George Pataki, helped to administer the program. He confirmed that Trump was lying and stated, “He’s clearly wrong. I saw him say that and he’s obviously wrong.” Catalfamo went on to describe how the program actually worked for everyone else outside of Trump’s warped version of reality, “It was not part of the program to give money away for the other ancillary stuff. The way the program worked was to help businesses cover for uninsured losses. Businesses came forward with their losses and we covered part of them.”

  10. Hillary Clinton' health is of grave concern. This morning at 911 Cermony in New York; Mrs. Clinton had to be physically assisted with standing and walking to an awaiting car. Her aides gave the reason of heat exhaustion. Very difficult to watch. I can send her my well wishes; but I cannot give her my vote. Both canadates should release a full medical report as to their health and fitness to hold office.

Although it's interesting that one of the few requirements to hold office is that one must be 35 years old, because when that law was written the average life expectancy in America was 35 years.
